NOTICE OF MEETING OF BOARD OF DETERMINATION

Notice Is Hereby Given to you as a person liable for an assessment that the Board of Determination, composed of Ted Dusseau, John Garrison, Roy Walker or alternate will meet on Tuesday, February 5, 2008 at 7:00 P. M. at Adrian Township Hall, 2907 Tipton Hwy., Adrian, MI, Lenawee County, Michigan, to hear all interested persons and evidence and to determine whether the drain known as the Stevenson Tile Drain, as prayed for in a Petition.

"The petitioner is the County Board of Road Commissioners for the County of Lenawee, State of Michigan, and does hereby petition for cleaning, widening, deepening, straightening or extending of a drain known and designated as the Stevenson Tile Drain, located and established in the Township of Adrian , County of Lenawee.

"The petitioner further shows that this petition has been authorized by its governing body and that cleaning out, widening, deepening, straightening or extending of the drain is necessary for the construction or maintenance of a highway, to wit: Bent Oak Highway, S ( Section 23 - Adrian Township (T-6-S, R-3-E). A copy of the Resolution of the Board of Road Commissioners is on file.

"Your petitioner further shows that the established drain needs cleaning out, relocating, widening, deepening, straightening, tiling, enlarging, extending or relocating along a highway, adding of lands to drainage district and a study to investigate drainage and flooding problems occurring along the Stevenson Tile Drain, within the Stevenson Tile Drain Drainage District and implementation of improvements to the drain for relief of proposed improvements to Bent Oak Hwy. and Valley Rd. in Section 23 - Adrian Township; existing tile drain commencing in the north bank of Beaver Creek at a point located approximately 1,468 ft. South and 264 ft. East from the NW corner of E1/2 SE1/4 Section 23 (T-6-S, R-3-E), thence proceeding across Section 23, through Valley Rd., across Section 23, through Bent Oak Hwy., across Section 23, through Wisner Hwy. and across Section 22. Also, including South Branch of Stevenson Tile Drain, commencing at Sta. 57+00 of main drain, thence proceeding across Section 23, through Wisner Hwy. and across Section 22, according to survey of record by J. L. Richard dated November 5, 1913 or to another point determined to provide adequate drainage of such drain is necessary and conducive to the public health, convenience or welfare of the Township of Adrian for reasons of taking surplus water across adjacent lands for the construction or maintenance of the afore-described Bent Oak Hwy."

 dated October 24, 2007, and said improvements are necessary and conducive to the public health, convenience or welfare of Adrian Township in accordance with Sections 72 and 191 of Act No. 40, P.A. 1956, as amended, and for the protection of the public health of the following cities, villages and townships: Adrian Township.

You Are Further Notified, that persons aggrieved by the decisions of the Board of Determination may seek judicial review in the Circuit Court for the County of Lenawee within ten (10) days of the determination.

STATUS OF STEVENSON TILE DRAIN PETITION
 

October 24, 2007 Petition Returned by Lenawee County Road Commission.
February 5, 2008 Board of Determination consisting of Ted Dusseau, John Garrison, and Roy Walker found not necessary the Stevenson Tile Petition.
Right to appeal: If any person feels aggrieved by the determination that the petition is or is not necessary, that person may file an action in the Circuit Court within 10 days after the determination.
February 26, 2008 No appeals filed on Board of Determination's order for no necessity.
