NOTICE OF MEETING OF BOARD OF DETERMINATION

Notice Is Hereby Given to you as a person liable for an assessment that the Board of Determination, composed of Bob Knoblauch, Ken Mitchell, Cliff Buehrer or alternate will meet on Tuesday, February 5, 2008 at 1:00 P. M. at Fairfield Township Fire Hall, 9965 Brown St., Weston, MI, Lenawee County, Michigan, to hear all interested persons and evidence and to determine whether the drain known as the Hoadley Tile Drain, as prayed for in the Petition (needing cleanout out, relocating, widening, enlarging, deepening, straightening, tiling and/or extending commencing at a point located in the West bank of the Baker & May Drain located in the SW 1/4 SW 1/4 Section 9 Fairfield Township, Michigan T-8-S, R-3-E thence proceeding across Section 9, through Lyons Highway, across Section 8, through Horton Road, across Section 5, across Section 32 of Madison Township, across Section 5 of Fairfield Township, through Sand Creek Highway, also including the west branch across Section 5, according to surveys by J. L. Richard dated December 31, 1913 and January 1, 1914 and Walter E. Frazier dated October 11, 1961, or to another point found necessary for improvements of such drain is necessary and conducive to the public health, convenience or welfare of Fairfield & Madison Townships.

"All culvert crossings to be checked for proper size, grade and condition and corrected, if found necessary, for current stormwater flow.

"Excavated spoil to be spread on right of way to a height not to exceed eight (8) inches.

"Brush and debris to be removed and piled at intervals on right of way, separated from spoil, to be disposed of by landowners.

"Drain channel banks to be checked for proper slope and stability and corrected, if found necessary.

"Tile outlets to be plainly marked in advance of construction.

"Existing tile determined to be replaced shall be destroyed.

"Existing and functioning connections to tile, as may be found, shall be reconnected to new tile.

"Drain district boundaries and apportionment of benefits to be reviewed and changed, if found necessary, by the Drain Commissioner",


dated November 28, 2007, and said improvements are necessary and conducive to the public health, convenience or welfare of Fairfield and Madison Townships in accordance with Sections 72 and 191 of Act No. 40, P.A. 1956, as amended, and for the protection of the public health of the following cities, villages and townships: Fairfield and Madison Townships.



Proceedings conducted at this public hearing will be subject to the provision of the Michigan Open Meetings Act and you are further notified that information regarding this meeting may be obtained from the County Drain Commissioner. You Are Further Notified, that persons aggrieved by the decisions of the Board of Determination may seek judicial review in the Circuit Court for the County of Lenawee within ten (10) days of the determination.

STATUS OF HOADLEY TILE DRAIN PETITION
 

November 28, 2007 Petition Returned by Karen VanDeVelde.
February 5, 2008 Board of Determination consisting of Bob Knoblauch, Ken Mitchell, and Cliff Buehrer found necessary the Hoadley Tile Petition.
Right to appeal: If any person feels aggrieved by the determination that the petition is or is not necessary, that person may file an action in the Circuit Court within 10 days after the determination.
February 26, 2008 No appeals filed on Board of Determination's order for necessity.
